We find that many people are not clear on the differences between the terms “Public Water”, “Private Water” and “State Owned Water” Our department is a branch of county government, and we hold the deed to the entire land of West Boggs Park, including that which forms West Boggs Lake. Who holds the deed owns the land, and so, yes do own West Boggs Lake. However, under Indiana laws, that still classifies it as “Public Water”, because we are a public agency; albeit not a state agency. This also makes use of the lake subject to all state laws and regulations pertaining to public water. That is why you still need a fishing license to fish here; and why INDR is permitted under their own rules to manage the fishery, enforce fishing and boating laws, etc. Those laws and regulations pertain to all public waters in the state, not just those owned by IDNR.
