Biden was talking about if a justice was to retire at the last minute of the Presidents term in office so that the current President was able to appoint his/her replacement before the election. If an old fart on the Supreme Court is thinking about getting out of the game then decides that if he retired while the President of his political persuasion was still in office he would retire before the next election.

But this is not the same thing when a Justice Dies in office. So what Bidden said is a little different situation with Obama as compared to when Bush was in Office and one of the Justices was thinking about retiring. Bidden was talking hypothetically at that time the SCOTUS was full.

Note how all the GOP changed their minds about this process once they were in the majority of the US Senate. When they were in control of the White House and the minority in the US Senate they were saying the very same thing that Obama is saying right now.

very sensible post, and I agree both parties are just alike, if both Dems and Pubs worked as hard for the good of our country, as they do against each other, we would live in a much better place..
