True Story you have to read!!!
My sister has a pond in her subdivision thats about 10 acres, and is surronded by homes, my sons girlfriends Mom owns one of the homes right on the water, so I thought I would give it a try, and make a few cast. I recieved permission to fish on her property, and the property next door to her. Started fishing, and catching some nice quality bass, so I slowly made my way down the bank, as I am fishing some old man, about 80 years old walks onto the property I was fishing, and looks at me and says, "if you step foot on my property, I will call the cops and have you put in jail" which I reply nicely, I am not on your property, nor was I going to get on your property without permission, which he in returns calls me a prick, and walks off. I get to the end of the property I was fishing, which is next to the 80 year old mans property, and start casting out into the lake, he again walks out to me, and tells me that I cannot cast out into the pond where his property is, I once again told him nicely, I am not on your property, and you do not own the water. He calls me a prick again, and walks off, well where I am standing is shallow end of this pond, and I whack 3 really nice fish, 2-3lbs each, and yell down at my son to come down to this end, and fish with me, he is 16 and loves to fish, so he comes down, and catches one, so we continue to fish at this end, and out comes the old man with his pole, he cast out right in front of us, his pole has a bobber on it, but no lure, stands there, tells me I dont know why you pricks have to fish at this end, I do my best to ignore him, and actually ask him if he needs a lure for his pole, he tells me I aint fishing you pricks, I am just blocking you from fishing my water. I could not take it anymore, I told him in so many words what I thought of him, and didnt appreciate his language around my son, this old man grabs his pole and acts like he is going to swing it at me, I told him that I dont care how old you are old man, you hit me with that pole, I am going to stomp your old ass in the ground, and call the cops, well he didnt like that to much, and by now, my sister, brother in law, wife, sons girlfriend, and the neighboor whos property I am on, are all standing there looking in misbelief that someone is that big of an *******, and they all start telling him what a ass he is, he grabs his pole and walks in the house. 10 minutes pass, and two cops cars come cruising down the street, and I knew exactly why they were there, he called the cops and told them I verbally and physically threatned him, so they talk to him, and I can hear him lying to the officers, so we just wait, and of course they come over, and start asking me questions, telling me what he said, and of course we have 8 people there to tell them the truth, and what he had done, in the mean time he walks down to the pond and starts again, tells the cops that I was casting into his water, and he wants me locked up for trespassing, finally one of the cops must of been a fisherman, tells the old man, as long as he isnt on your property, he can **** well cast wherever he wants to, and tells him to get on his property before he gets locked up, the look on the old mans face was worth the whole ordeal. Sorry for the long story, but I could not believe that there are people on this earth that are so mean and nasty, and I left out a bunch of other things he said to me and my son, but I had to pass this one on, because its a classic. I am going to get a two man boat, launch it, and fish all around his property just to piss him off. Has anyone had this happen to them? And does anyone know the law regarding fishing ponds in subdivisions? I want to make sure its legal to launch a small boat like that in a neighboorhood pond, and fish around it.

I've encountered many an angry resident while fishing private waters where I had permission to fish where I was at. Some people like to think that they can own water and fish. I would do exactly what you said you are planning on doing....get ya a little two man boat, launch, and fish all over his side of the lake....yelling loudly with each big bass you catch! :D That will be hilarious to watch as he attempts to cast his bobber out at your boat and snag ya!

Had the EXACT same thing happen to me in a suburb when i lived in south carolina fishing on a friends property. You would have thought i was out there pouring gasoline in the lake or something that guy was so mad at me. Just because i was there.

yes, this year i was going down a bank that cuts in and out. couldnt see anyone was there on the bank through the trees. i came around the corner and heard people, so i quickly cut out to the middle to go completely around them since they were there fishing. i was no where close to them whatsoever. then i hear a guy mouthing me saying he cant believe i have to fish on 'their' side of the lake. i immediately went back in front of them even though i was still plenty too far to even think about casting to reach where their lines were. guy stands there and starts mouthing about how im fishing in his spot. i told him i was going around until he decided to change my mind. then he makes sure i see his other poles all down the bank. i cast right between them and said 'man, i didnt see those, sorry' man they were pissed, but its their own **** fault...lol

me and a friend was floating down the river once had a old man come out and tell me he usually dosent allow people to fish there. so i politoley asked since he seemed a little shy of a full load if he would mind if i fished there just for today. and he said i guess its ok and all was good till my friend lost about a 6lb largemouth and his wife said im glad it got off. it would have been released anyway. but boy did he ever cuss them both. then they called the gamewarden and he told them they didnt own the river and as long as we was floating there was nothing they could do so go back inside and leave these boys alone.

Knock on his door and ask him was he at the Flying J a couple of springs ago when he smarted off to elnut and threated to flatten the tires on his boat trailer.

Well I hate to tell you this but if his property lines extend into the pond, which is done in about half of the cases of a subdivision lake (pond), which divides the lake into ownership YOU WERE TRESPASSING. If this was the case then you and the policeman were incorrect and your were trespassing period no questions about it. It all depends on how the lake or pond is platted or surveyed out. A lake or pond is NOT public water and there is ownership of the land surrounding and under the as well as the water in a fully enclosed impoundment of any type. A free flowing stream is public waters which is not an isolated pond or lake.
Then you get into the deal of is this lake dedicated to public use, if so then it is public water, but to do that is must have PUBLIC access.
Here is another, was the pond created for use by the subdivision as a part of the subdivision on its own tract of ground if so again you were more than likely trespassing, unless you read the restrictions and regulations creating this lake for the subdivision then you do not know for sure if you were allowed to fish and under what regulations.
Most of the everyday person, including most policemen do not understand boundary laws period, they think they understand but they soon find out it is not what they have always been told.
I have been the Surveyor in the middle of a couple of disputes over very similar circumstances, believe me when I say this, you may have been trespassing if you were crossing his property line period. Ownership, boundary line or lot line what ever you wish to call it does not stop at ground surface.

I need to add this, if 8 lots extend into the pond then all 8 have ownership of the water and you would have to have permission from all 8 unless the restrictions were setup so that anyone could fish as long as one of the owners gave permission but I would hate to goto court to prove this. I have seen that done gets costly to prove a point.
