RE: Police ticketing fishermen in Captains Quarters
Heres the deal after reading these post. The names of the fishermen have a right to privacy. I will not say there names or the tournament. The fisherman were not DQ'd. If us fishermen observe every NO FISHING sign, we would not have a place to fish. I can name places that have no fishing signs just as a scare tatic. The big stink in Captains Quarters is that a guy complains to us fishermen that our fishing line is clogging his pumps and he has to replace them. So, if this is true, by keeping us out no fishing line will get into his pumps???? I think NOT. The river rise and currents flow in and out of Captains, but that is there thinking.
RE: Police ticketing fishermen in Captains Quarters
Hey senko what do you mean by real crime? What these guys did is illegal. This matter went to the US supereme court in the 1970's out of Florida. If the officers are assigned to the river patrol and they are getting 100+ complaints a week, what should they do just ignore people who pay taxes and have the right to keep people out of their property. If CQ is paying off duty officers and they do not enforce the law that they are being paid to do than it looks a lot like theft of services. I have a great idea fill out an aplication and you too can fight real crime. Well, I'm off to KY lake for the weekend see ya when I get back. I don't agree with it but, I don't have the money to fight something like that in the supereme court.
RE: Police ticketing fishermen in Captains Quarters
This is from the KDFW 2006 Fishing and Boating Guide:
“May I fish around a dock or a marina?” It depends. Public marinas on U.S. Army Corps of Engineers Lakes have contractual agreements that address lease space on public waters. The Corps presently allows the marina owners or operators to post signs that prohibit fishing within 150 feet of their floating structures. These agreements do not prohibit a person from fishing in their boat rental slip. This policy does not apply to privately owned boat docks on Corps lakes"
The only tickets I know that have been given out down here on Ky/Barkley for this have been tickets for tresspassing so no you probably are right about there not being a law against "fishing" around a marina...but there is a law about tresspassing on posted property....like it or not it is the law and is being enforced in some marina's here and elsewhere.
most of you missed my point!!
The point here being, right now its the marina owners that are getting away with posting there watrer No Tresspassing, soon it will be Private dock owners, then it will be Bird watchers, soon it will be any area that someone dont like to see someone fisahing as they are watching the sunrise. No I am not over reacting. No one ever thought someone could sue the Gun companies for a crime committed using there products either. I could go on foprever on this issue way to much to argue on this forum. I dont even live in that area and have never fished in CQ, but The marina owners on Cumberland, Barkley, KY Nolin and others are taking everyonesrights away.!!!!!!!
RE: Police ticketing fishermen in Captains Quarters
Richie,
You ought to know by now---money talks. The boaters and marina operator can afford to do this. Most agencies can't afford to fight something of this nature. As far as your KBF comments and about them standing up for this "injustice"---where do you expect them to get the money to fund such a fight??? Are you a KBF member? How about a BASS member? Are you member of any fishing organization that could help fight this? Where's your role in all of this. You fish the river----don't you?
If so---what did YOU or YOUR organization do to fight this???? I am willing to bet nothing. Just like I didn't and just many, many others didn't. Shoot, I didn't even know it was going to State Supreme court and I fish the river all of the time for the past 15 years. So, bottomline: I wouldn't point fingers because you and I are just as much to blame to let this kind of thing happen. Think about it?
RE: Police ticketing fishermen in Captains Quarters
I have to agree with the earlier post,do the fish on the river and the lakes only live around the off limits areas at marinas?
Not trying to argue but if it bothers you that bad start a petition, call a rep and go up from there but i bet the money is gonna win...heck take a day to ride around enjoy the river and find a "spot" no body else knows about and let em have their quarters we got the whole river,if your boat broke down there i bet they wouldnt lend you a phone:)
RE: most of you missed my point!!
Exactly, we as fisherman have got to stand up for our rights to fish navigable water. Its been fought for several years with waterfowl hunters on what can be floated or used to access other water.
We've got to stand up against the marina's or just like what was mentioned before, everything will have a posted sign on it and the owners will be throwing a fit to have tickets written. Also, I think our Police and Game Wardens have more important things to be doing than resonding to calls from marinas and dock owners about someone fishing near their slips.
Our country and states have become so lawsuit and legal happy the last several years that if it doesn't stop we're going to loose any right and location to fish that we have.

RE: Police ticketing fishermen in Captains Quarters
I don't fish this site on the river so can say nothing there but i do know that most marinas that post their docks do so to try and help protect the boats and propery of the people paying to dock their boats there. I know if I had a houseboat, pontoon, cabin cruiser,or bassboat docked at a marina that I payed $1000 or more a year to keep there I would hope that it is protected. I can bet that if anyone here had someone bounceing jigs and spinners or whatever off of your $20,000 to $30,000 bassboats they would be irate to the point of fighting. Legal or not to post these areas we should all show this respect for others property. There is plenty of other water out there to fish.
RE: Police ticketing fishermen in Captains Quarters
Thanks for the information Dave. It sounds like we pay our federal taxes to the Federal Goverment which supports the Army Corp of Engineers. The ACOE then sells or leases the property that we all helped to pay for to a PRIVATE CORPORATION who in turn posts no trespassing signs to keep the general public out of the area. 150ft around the structures is leased to the LUCKY owners of these precious marina's.
Sounds like corporate welfare to me.
Why should anyone be forced to stay 150ft away from anyone's buildings? I guess it's because the rich have the money to buy the politicians and the judges off.
Sure there are other areas to fish but eventually all the water may be sold off to the highest bidder.
Here in IN the governor is selling our highways to the highest bidder. I think that Spain will own our toll road pretty soon.
It's getting to be more like Surwood Forest every day. Where is robbin hood when we need him.
