was your friend by himself?been checked a few times crappie fishin with more than one limit in one livewell and never heard such,,even if you use seperate livewells what's to say i didn't help my buddy catch a few of his?

Parker, supposedly all American citizens are innocent until proven guilty and reserve the right not to incriminate themselves, no matter what lies the police tell you, which by the way they are 100% within their rights to do, in fact it is usually the first thing they try when you don't back down, if outright intimidation fails of course. Anyway, you always have the right to remain silent. In other words it is their responsibility, their job, and their duty to prove you committed a crime, not yours, unless you like paying fines or being jailed. No, it is not "legal for someone to help someone else in the same boat catch his limit," come on now. Fish and Game has a lot more wiggle room than other law enforcement officers in these situations but if they are behaving ethically and they have no evidence of a violation they can't prove you did anything illegal. On the other hand, when it is just you and another man with a gun and legal authority telling you whats what it is up to you how you want to handle that. We all know that law enforcement agents can write you up for anything if the notion takes them, then it is up to you to dispute the accusations in court, at which point a judge should require them to show them their evidence. In most cases where you are actually in the wrong and they decide to take it farther than a warning they will collect, keep and, show that evidence but, if the only evidence they have is "I, a certified Lawman saw Joe Blow break the law," guess what, bang, bang goes the gavel. Absolutely not. If you have two legal anglers in the boat you are allowed your two limits.

The possession limit would not apply. When you're out on the water fishing (or standing on the bank, whatever) all you can legally have in your live well, on your stringer, in your basket, ect, is the daily creel limit. That is all the fish you are legally allowed to catch and keep in a day. If you catch your limit, take them home, then go out and catch more, you're breaking the law.

Yes. And if you're storing them at your "Primary residence," you could go out a third day and catch and keep a limit legally. Where the possession limit comes into play is when you're "in the field," like if you're camping, renting a cabin, or even staying in a cabin you own that is not your primary residence. In that case, if you've gone out fishing two days and have caught and kept a limit both days, if you were to fish a third day, and still have all the other fish, you'd be in violation as soon as you caught and kept your first fish (possession limits, at least in most states, are equivalent to twice the daily creel limit). BUT, there have been times when I've had upwards of thirty trout in my freezer here at my house, and since it's my primary residence, that's perfectly legal.

Even if you do have two live wells, there still is no proof of who caught the fish. If I filled my limit & the guy with me has not, I could put fish in his also.

I read this at the KDFWR website that the possession limit excludes processed fish.

It doesn't matter who caught the fish if there are two people on board with valid licenses and two daily limits. And you can keep them in one live well, cooler, etc. As has been stated, possession is for being in the field for more than one day. In that case, the first day's limit must remain in the field and not on the boat.

For some reason I always thought it didn't matter if the fish had been processed or not ("processed" meaning gutted and head removed), but you're right, they're excluded. Thanks for pointing that out.

It is not legal for one man to catch the limit for the both of your or even more poeple. Legally, each person can only catch and keep his or her limit. 1 guy can't keep 10 bass if there is two of you in the boat, you can only keep 5 each etc. if the limit was 5, regardless of the species. Now the DNR proving it is a different story, but if you flat out tell him I caughts 8 and he caught 3 you will get a ticket.
Livewell does not mater how many are in each. Like others said creel and possesion are different.

I aint sure about the legal side of who caught how many. But this is what I know. If there is more than one fisherman in your boat, as owner and operator of your boat, you will be ticketed for fish violations such as sub legal size or over total creel in your boat at the time the officer checks your boat even if you didnt catch the sub legal or the over creel fish that was put in your livewell.... YOU WILL BE RECEIVE THE CITATION
