Had the HOA come to my hand house in Lexington..Once....and that was enough for them I guess. Complained about my truck...Ole Blue...I told all three to ride the bologna pony and get off my property.
Never heard a peep out of them since,
My brother bought a house in a subdivision that had a 12 acre community lake. The HOA dues helped keep the lake stocked and maintained.
This was a well and good untill the property owners with lake frontage decided that they were the only ones with access to the lake.
The HOA notified my brother to cease fishing activity in the lake as his house was accross the street from the lake.
The Subdivbision Platt had the lake area designated as community property. My brother argued that this lake was for the community to enjoy, he paid dues to maintain the lake and when he bought the property it was under the understanding that he has access to the lake.
The HOA response was that he was able to enjoy the estetic value of the view of the lake when turnning onto his street, the lake improved the value to the subdivisions properties in that by just being there attracted investors/buyers.
So the end decision by the HOA was you can look but do not touch.
Over 60 property owners suplement and maintain the private lake that is accessed by about 15 property owners.
He had two choices 1) sue 2) sell. He sold the house (this was before the housing bubble) before this issue became a widespread issue and hurt values of non frontage properties.
Bottom line.......Read the fine print.
I would have poisoned the lake and burned down everyone of those **** houses........

In my brothers case, the Atty. told him he probably had an implied easement to the lake as they were at one time on the same tract of land as his house, he was part owner of the lake and it was landlocked. But the legal costs outweighed just selling.

I would be willing to bet that 90% or more of the board is comprised of women...which is the source of many oddball ideas and restrictions.
The HOA for my neighborhood is 100% women.

I would rather be neteured than live in an area with an HOA! I think I am smart enough to take care of my business without some nosy neighbor telling me what I can and can't do, and I dang sure would not want to be one of those people that tell you what you can do with your property. Plus, I tend to think that "lowering property values" is just a way for some ******* to try and force you to do what they want.
