    Drinking.....

    Ok so I was wondering if it's legal to drink a few beers while fishing the bank on a river or lake. When I mean a few I mean a 6 pack or less. Would that be considered public intoxication or what? I know the laws regarding boating and drinking. I see no harm in drinking on the bank unless I was to leave my garbage behind or had a few to many and decided to drive. Me and a buddy went back and forth on it but I believe that if caught by wardens they would write a citation. Any thoughts fellas?

    Yes they can give a citation for it and will, depends on the warden.

    I don't drink much in public it's to easy to get caught...that's why I smoke dope!! Kidding!!
    I think that's a good question for a law enforcement dude or dude-ette. I always lean on the conservative side so when in doubt I don't do it.

    Yes it is illegal it is drinking in a public place. If you are going to do it put it in a red solo cup or other cup and don't be obvious about it. I

    I had the feeling it was illegal. I don't believe I'll take any chances. But the red solo cup wouldn't be a bad idea
    However I think I'll just leave the beer at home lol

    If the officer sees you drinking he can arrest you for public intoxication. If he comes upon you sitting next to a 6 pack, he can ask you if you have been drinking. If you say yes he can arrest you. He will not give you a breathylyzer test because that may prove him wrong. He will take you to jail and you will have to pay a fine. If you say no and you already drank six beers most likely he will not arrest you unless you are causing problems.

    Where did you come up with that? Never in my life even heard such BS.

    From experience. Unless you are driving a boat, you do not have to give a breathalyzer test. The former police chief of vine grove told me that on the way to jail one day.

    so what you are trying to tell me is that you dont have to submit to a breathalizer if your dont want to unless your operating a vehicle. I can see your response now, "Uhm occifer I am not going to submit to a breath test because the vine grove policeman told me that i didnt have to as he was taking me to jail." I do believe that there is going to be some reprocussions to refusing to submit to any field sobriety tests. If you refuse either way in my own opinon you are going to jail for public intoxication or disorderly conduct. Just an FYI being uncooperative with law enforcement never ends well. But you seem to be up to speed on jail house law so you can make that decision when the time comes..

    ZX150, i'm going to tell you a 100% true story relating to Tom's post. My Cousin and I were around 18 or19 and had been drinking, we may have had a couple a piece but probably started with a 12 pack. We decided we would drive down to the lake and fish awhile. We could drive the truck (illegally) about 100yrds from this big slate rock point, and we both grabbed us a beer out of cooler.

    We had been there about 15 minutes when we heard a boat, we paid it no mind until it turned our way. Here we stand with two beer between us with ice cold/cooler water ring stain on that slate rock point. Two wardens pull up and ask us for license and then "Have you two been drinking"? No sir, " That is not your beer"? No sir. As they were leaving one turned around and asked us if we would mind taking our cans with us.

    They could have fined us for the truck, and they definitely knew those two beer were ours, so I think Tom's post has merit.

    So you completley lied to an officer that obviously knew you were drinking and they said nothing exept to clean up after your selfs? I find that lying does you no good with anyone, even more so with law enforcement. I just find it strange that they didn't say anything at all about being lied to. You must of caught them on the right night
