so what you are trying to tell me is that you dont have to submit to a breathalizer if your dont want to unless your operating a vehicle. I can see your response now, "Uhm occifer I am not going to submit to a breath test because the vine grove policeman told me that i didnt have to as he was taking me to jail." I do believe that there is going to be some reprocussions to refusing to submit to any field sobriety tests. If you refuse either way in my own opinon you are going to jail for public intoxication or disorderly conduct. Just an FYI being uncooperative with law enforcement never ends well. But you seem to be up to speed on jail house law so you can make that decision when the time comes..

Are they gonna take your shoes if your not driving and refuse? ZX150 knows this. Your word against the officers evidence. A few cans or alcohol smell will not suffice, better have someone handy that the drunk tripped over.What evidence would the officer have if you refused a field sobriety test?
