I have ZERO tolerance for people drinking and driving. Drinking and driving (to me) is the deadliest combination on the roads. Growing up we some friends down the street who lost their child because a drunk driver lost control and ran into their yard and ran her over and kept driving. Many people have stories of how drinking and driving may have affected their family or lives and I would bet the drunks thought they were fine. Anyone ever try and reason with a drunk? It's maddening!!!!

I have friends who still drink and drive because they get away with it and some of them have been caught before!! Maybe the penalty for drunk driving isn't strong enough?? I also know that if you know the right people you can get some soft penalties and that infuriates me.

I'm not much of a drinker...maybe 1-2 beers a month and that's only if I attend a cookout or go play pool. I just don't desire it like I did as a young man. I totally understand people who can drink a beer or two and function as if they haven't had a beer because there are so many variables in how that alcohol effects them and it also depends on the alcohol content of the beer, but if you get caught pay the price. It's the price of breaking the law and I'm not a hard ass on laws but I am on drinking and driving.

I have learned that texting and driving is pretty bad as well. There was a time I would but now I don't because I have had close calls even though I thought I was fine doing it. It's actually nice to not deal with a phone while driving. I won't take calls 99% of the time as well. My SUV has Bluetooth so answering and talking are easy and hands free but it's nice to "be off the radar" and just listen to music while driving.

Darn, sure wish I was sober enough to try to comprehend why all this deserves comment.

Google "KY public intoxication" and connect the dots.

Even a stoned stoner could go into any court in Ky and beat a public intoxication charge unless he was endangering himself or others. I think there is precedent set as well.

Kingfisher, as far as lieing to law enforcement, lmao! Do you think leo's have ever lied to citizens to achieve a desired result?

I do believe that there is going to be some reprocussions to refusing to submit to any field sobriety tests. If you refuse either way in my own opinon you are going to jail for public intoxication or disorderly conduct. Just an FYI being uncooperative with law enforcement never ends well. But you seem to be up to speed on jail house law so you can make that decision when the time comes..
What evidence would the officer have if you refused a field sobriety test? If you are not causing any trouble there shouldn't be a problem. If you are not operating a boat or car there is no requirement for you to agree to a test. They'll take your driving license if your driving while intoxicated and refuse. Are they gonna take your shoes if your not driving and refuse? Think about it.

ZX150 knows this. Your word against the officers evidence. A few cans or alcohol smell will not suffice, better have someone handy that the drunk tripped over.

If there is alcohol open in public and there is not a liquor license that allows it than it is a crime. If you have blood shot, eyes unsteady on feet, slurred speech than you are AI. No won't take your shoes but may spend a night in the jail.

The point that I'm trying to make is that if you give a CO the evidence he can take you to jail. I was fishing with a friend on Rough a few years ago. We were just up in a cove casting toward the bank when we had the CO's pull up and check our license. They ask me what we had in the cooler. I told them "a couple of beers and some water". No beer were open. They ask me if I had been drinking and I said no. They ask me if I was driving the boat and I replied "Yes". They gave me a breathalyzer and I passed. They ask my buddy if he was drinking and he said yes. They asked him if he would take a Breathalyzer and he agreed. They took him to jail. My buddy told me that all the CO's talked about on the way to jail was how glad they were to get off the water so they could catch up on some errands. If my buddy would have said no to the question and test he could have kept fishing.
