Blood shot eyes, slurred speech, unsteady on feet = AI? Good luck making that stick to anyone but a moron! I suggest you look up the statute.

To answer how a person is considered "manifestly under the influence of alcohol" the fore mentioned will be evidence of of the same.

This seems to be rather subjective to be considered acceptable evidence. But I'll take your word for it. I look at it this way. If a cop arrests you, you are screwed. Even if you are innocent you still have to pay a price (missed work for court appearance, hiring a lawyer to prove it). So even if you're proven innocent, you still lose. Many people choose to pay the fine because it would be less expensive than to go to court and defend themselves. The policeman is not your friend. Don't volunteer any information or to do a sobriety test unless operating a vehicle. Volunteering to take a sobriety test is the same as consenting to a search. Do everything to protect yourself when a policeman approaches you. If an individual is intoxicated and is a danger to himself or others or interfering with another individual's pursuit of happiness then police should take action. If a guy is just sitting and fishing with a 6 pack and not bothering anyone then the police should just wish him a good day and move on. Just like every other organization there are good employees and bad. The same is with law enforcement. Many times doing what is legal for the officer does not make it right.

Most of the time that is the case. If your are sitting there minding your own business it is fine. But, 99 out of 100 that is not the case. Not volunteering info can get you into jail faster than anything. If I'm there and ask do you have anything that could get you in trouble, nope not at all I find it well a warning or ticket could have been the fix now since you lied you get to go to jail.

Ya know I can honestly say I have never lied to the Police and I have had oppuntinities to several times. I was pulled over coming home one time and was asked have you been drinking tonight. I said yes and I was fine and about 10 minutes from home. He said how many have you had and I answered 6 to 8 but over the course of several hours and I had ate dinner with the family I was with.

He looked at me and said I have never had anybody say that. I hear mostly yea I have had only a couple, I laughed and said I know you hear that all the time. He asked me a question and I gave him an honest answer. Six to 8 beers doesn't phase me especially if I have eaten. He saw that appreciated that I told him the truth and treated him with respect and told me to have nice night and go home.

In my travels of growing up I was quite a Hellun back in the day. Of course way back when I was in high school they just made us pour out our beer in the road and we went and bought some more, lol. However I have only run across a couple of ******* Cops but most 95% plus for me have been great people, treat them right and respectful and you will get the same in return.

I did a ride along with a kyfw officer and he gave me some excellent advice. He told me "I always know the answer to the question that I am about to ask someone." He went on to tell me if he sees people on the river bank he dont just stroll up on them without watching them from a distance to see exactly what they are doing. He will watch the individuals actions to get a feel about who may cause him problems and how many people there really are and what they are actually doing. So generally if a CO rolls up on you they know already what you are doing and lying to them only makes it 100 times worse.

And he can take his binos and a quarter to a pawn shop and trade them for a used fork? Sad that the guy you rode along with won't bother the northern boaters flagrantly violating Ky laws, but let him have a shot a couple riverbank hicks = easy quota?

If only Lake Cumberland could be blessed with that CO and a poster in this thread during the poker run bash, hell the Ky Derby would be easy pickins for some if it's that easy.
