Before you delete the post ask to see the patent. I think if you were installing the lights and charging money to do in you might have a patent infringement but I doubt that an instructional video infringes on a patent.

Ahh, a patent issue. Great ideas are great to patent if they can be enforced. This one, not so much as people can buy stock parts to do themselves..

I would nicely ask the gentleman for his full name, address and the patent number. If it's ligit, i'd take down the video. Don't know if there are any law dogs here, but I'd prolly take it down even if it's patent pending. In your informational request, let him know you plan to oblige his wishes once the patent is confirmed. This could help if the dude is weird and goes after you for having a vid out there two days longer than he thinks you should. Suits may be the only way this guy will make anything at all off this.

I think a how to would infringe if the patent is for a process.

I would bet $500 of MHall's money that this guy is pulling your leg. Tell you what, forward me the e-mail at [email protected] and I will show them to my brother in law this evening. He is an attorney with a law degree from one of the most prestigious law schools in the country. He is licensed by the bar in Ky, VA and In. I promise you he will know.

Oooh, I'd take Tim up on this. I'd still try to get the patent info.

Was the person who told you it was illegal possibly one of those tree stump lawyers? They usually know everything but the law.

If your video is illegal, would it not also be illegal to post videos of people catching fish, shooting carp, etc.? I don't see a problem as long as you are not profiting through the mfgrs. brand by selling the video.

IMO, that person is jealous that you thought of the idea first. Slap him and the horse he rode into town on.

The guy sounds like he wants to take your idea and patent it which dishonest people do all the time. Call his bluff and tell him you already have a patent number on it and if he had tried to get one, the patent office would have refused to issue it. Saying he would "use the law against you" is a red flag because people who know what they are talking about would have made a more intelligent statement. He would have also been more specific on what law he was talking about. Nah! I don't believe him. LEAVE THE VIDEO UP and don't delete it until he PROVES he holds a patent number. Make him produce it.

If he had a patent on it and you were infringing on it, you would be hearing from his lawyer...not him.

Re: please read, I need to know something.

I'd like to thank every one, that replied to this post. the video of the blacklight inside the rub rail installation, was the only one of it's kind. on youtube that I could find. when I did my lights, I searched for a how to video and couldn't find one. thats why I made the video. to help anyone that wanted to do the lights themself. I really don't see how the video would hurt the guys business, because any one that has the big bucks to spend. are going to hire the work done. and the do it yourself guys, may find the how to video helpful. but they aren't going to hire it done anyway. I don't know the law on this kinda thing, and sure don't want to spend money that I can't afford. to find out. so I am going to delete the how to video.

thanks Tim, the guy didn't send me an email, he called me. but if you talk to your brother in law. tell him the story and see what he says. I already deleted the video. but if it's not against the law to have it on youtube, I can put it back up. Tim, all I got from posting the video. was a lot of thank you's from guys wanting to do the lights themself. you wouldn't believe the kind words that I've recieved from people out their, because of that helpful little how to video. and thats a good feeling.

Re: please read, I need to know something.

How'd he get your number? I'd put the video back up just to jerk his chain. I doubt that would even be a patentable process. It would be like patenting the way to install fog lights on your truck... If they guy did have a patent he'd slap you with a cease and disist order, not call you.
