With the 2011 Operation Dry Water comes a battery of tests that, after a three-year study, the Southern California Research Institute has validated for marine use. The new battery of testing standards will for the first time, allow marine patrol officers to tests boaters in a seated position and apply a percentage of probability that the subject is impaired at .08 blood alcohol concentration (BAC) or higher.

This means even tho your Blood alcohol is not .08 you can still get a ticket or go to jail..
If there is one thing I do hate about Ky. It is that every thing California does Ky. Will do.
I don't drink any more and never did while hunting or fishing but I think I will stay at home that week end. To me it is harassment for the little guy and just another way to make a buck for them. I do my best to stay safe and keep only legal fish but I have come home with one or 2 fish that seems to have shrunk a 1/8th of an inch for some reason and it would just burn my @$$ to get a ticket for It. ( I no longer keep fish that close anymore)

Personally I would start a boycott on this ! I'm like the rest of you if your going to check one check them all and leave no stone unturned..
I vote we get a bunch of video cameras and every one follow the game wardens around just to see who they are checking and who they let get by with illegal stuff ...

So if you're in a bass tournament, you don't want to be given the courtesy of a pass-over? I've always believed that if you are wearing your life jacket, or appear to be fishing a tournament, the KDFWR police boats tend to leave you alone to better focus their efforts on the runabout crowd....

Reguardless of this whole discussion no one should be drinking and driving a boat or any vehicle for that matter. And I LOVE my beer......but I know when the right time to drink is and isn't....

I agree with that! Seems like the cops just turn a blind eye to the rich pukes that rent the fancy floating houses. And then concentrate on the guys in the small boats. For crap sake, what has more room to carry more booze, a 80 foot 2 deck houseboat or a 14 foot jon boat? And which one cause the most damage with a drunk driving it?

Apologize for the rant, but just lit me up. I've seen the houseboat people throw wild crazy parites with lud jams going to the wee hours of the morning. Yet let "bubba" and his 14 foot Tracker crank up the jams at 3 am, and the bubble lights show up.

Law enforcement out be applied equally. And I am sure there are many fine officers who do so.

I was stopped and checked 10 years ago on the CR. Their breathylyzer didn't work, I passed all field sobriety checks and still spent thenight in jail in Columbia. They took me to jail in Burkesville and blew under the legal limit and still took me to jail in Columbia.There were many comments on the ticket about how courteous and cooperative I was too. The F&W guys just needed some time off the water to run errands.

I say that if your anchored and stay anchored, drink all you want, have fun! Just dont dare to operate the vessel afterwards. I also say it should be fine to have a dd on the water as long as no one is acting a fool and drawing attention.

Seriously, the law enforcement people have good, bad and ugly in their ranks just like every other profession. I was stopped in Cape Canaveral Port and found out we were being filmed for an info spot (training vid? News spot?) I can't remember....but he was putting on a show. Speaking to us as kids and here we were both older than he was. No biggie since we were not drunk and passed his test on questions and balance but it was funny how his demeanor changed once the cameras were on.

He shook our hand and said be careful and was never out of line. I guess my point is we could have been the film spot for how someone gets sent to jail for breaking the law instead of a spot on getting a warning.

If I'm breaking the law and get a ticket or whatever then I blame myself for putting myself in that position. If I get a break I consider myself lucky. If I get taken advantage of then I get pissed. I would be upset if I was in that situation you were in for sure.

1. I agree with the guy with the superman logo (can't spell his name) cause driving anything under the influence is dangerous to all, not just the operator.

2. The thought the KDFWR would not check boats because they look to be in a tournament would be a specific example of uneven enforcement. Another example would be lets stop the Corvettes for potential spending and let the mini-vans hit the school zones at 90 mph.

3. The thought that anyone can be cited for a violation of law, with out tangible and credible evidence that would support a reasonable assurance of a court outcome, to me, is just the equalivnace of unlawful detention and malicious prosecution. A good lawyer or two and several law suits might go far to reverse that trend.

4. It rained a lot at Nolin today, and there were no jumps anywhere from Wax to Moutadier. Bull bluegills were hitting nightcrawlers tight to structure at just 4-5 feet deep, Bass 12-15 inches long were doing the same, and the blue catfish were following suit.

WOW am i the only one here that likes to go out fishing relax have a beer or two and enjoy fishing? this is all about the money.. i'm not saying go out and get falling down drunk our nothing.. but if me and a friend wants a couple beers while fishing who's it hurting? it is legal to buy right? as far as renting a houseboat on the holler we do it evry year , it's our vacation.. me the wife and another couple split the cost in the off season and it's reasonable... were not rich by no means.. just a couple blue collar Union workers that a few here love to bash.. i work shift work and have for 31 years.. our idea for vaction is a houseboat trip.. we tie up to the bank relax drink a couple beers and fish off the back.. we don't leave our spot till were ready to come home.. so now big brother will bring this to a halt.. hows the marinas going to stay afloat when this gets into full swing?? and it will.. they had trouble with a few game warden at green a couple years back the marina owners had to go to frankfort to have them back off alittle... now it sounds like they have the green light now.. i can see the dollar signs now.. just my opinon.. again i'm not for getting drunk but a couple beers come on!!!

R82 I dont see nothing wrong with having a few cool ones while you are anchored or tied down.But I have seen tied down house boats with a couple of run abouts and several jet skis tied to them also, while they were partying,again, if they are stationary, fine, but what happens when the guy wants to water ski, or jet ski after having one to many?

I say throw the book at them... you don't need another law or a cool name like "operation dry water" to arrest them there's already a law against that.. you remember click it or ticket? there making a killing on that up here in northern ky... 400 plus here in florence.. and brag about it...

So let me get this straight... you guys dont want laws enforced that make our waterways safer? Right....

This operation is just a push to stop intoxicated driving. I am all for them running down boats and giving breathalizer tests all day long. They arent violating any rights, they are just trying to stop the stupidity. As far as I am concerned there is no room for alcohol in a moving vehicle. If you open a beer and the boat isnt anchored... you should go to jail because you are now endangering my safety. If you want to anchor and have a few.. fine. But if you pull anchor and are feeling even the slightest bit tipsy... you are no better than a DUI driver.

I for one will be out there that weekend, and will have a few thank you's for our law enforcment for being on the water.
