According to the ADA an employee that is a recovering alcoholic can come to work drunk as long as he/she can do the essential tasks of the job. However a recovering drug addict can be fired if they are tested positive for the use of illegal drugs.Yep I would agree except I deal with the ADA Codes all the time and like any law or standard it can be twisted and mangled to apply to anything or anyone.
I find very little in law that is absolute when in the hands of a skilled lawyer. Don't get me wrong this PC crap is out of hand IMO but ADA scraes the crap out of everyone.
