Businesses do it all the time. Their liability insurance company looks at the case, determines what it would likely cost in court to prove your innocence, then compares that cost to an out of court settlement.

I know of several cases where lawyers have told the accused that they can definitely prove their innocence, but it ends up cheaper in the long run to just settle. Businesses and insurance companies don't necessarily operate on principle...they operate on the dollar...

It does not surprise me at all that Cain would have settled out of court, even though he maintained that he was innocent.
