the railroad actually owns the property the tracks are on including the ballast line on each side of the tracks and often a much wider right of way than just the ballast. i do know for a fact that they consider it "tresspassing" if you are on their property. i work for the railroad and have seen some pretty sad outcomes from people hunting, walking, riding 4 wheelers etc on and around the rail. not to mention a pretty big collection of prized beagle hounds. i would ask landowners adjacent to the tracks for permission to hunt instead of tangling with the railroads.
