I'm arguing with a person about Castle Doctrine.......

    This happened in Wisconsin.

Was the homeowner justified......Would you also pull the trigger in a similar situation?

He was within the confines of the law, and acted legally....If you're in your personal residence and someone has gained entry without permission and intends to cause you bodily harm I fully agree with pulling the trigger

It's impossible for those of us who have never been put in such a situation to say what we would do, but I'd like to think I'd shoot...In a dark room it could be somebody that was hiding to get away from the cops or it could be somebody getting ready to inflict serious harm to you or your family...The world we now live in has changed, and I think all states should adapt such a law to keep honest homeowners safe

I didnt read the article but man would I have to be very threatened to pull the trigger! If its a matter of him taking some items is one thing but if he is thinking of killing me or my family is another. I wouldnt know what he was thinking but I would like to think I had an idea. I really dont know what I would do and hope I would never kill anyone. All my stuff is locked up so they would definetaly get the jump on me.

I'm willing to bet this could have been nothing more than a confrontation if he didn't shoot. It's terrible it ended this way and it's easy to second guess something that has already happened but I don't think I would have shot. Sure he had every legal right and I don't fault the guy but I would prolly take a beating or give a beating before shooting someone because the trauma/legal problems/nightmares or whatever of killing someone has to be overwhelming. I'm well armed 99% of the time and even then it would be the LAST LAST LAST option for me to pull it and use it. Jmo

JMO. First I figure if the person entered my home, he "may" be interested in me as well as my property, or may harm me just to cover what he has taken.
I start with the basic assumption that honest people of moral intent don't break in to my home.

If he's in the garage and no further, have a nice day and I'll talk to the insurance company.

If the person enters my residence, and my wife is home, I'll shoot first and ask questions later. I'm not going to become a victim because I looked out for a person breaking in more than I did for my wife, or for me for that matter. I'm not issuing a warning that gives the bad guy the opportunity to know my location and decide how to attack me.

If the person enters my home and the wife is no where close or in harms way, I'll give him one chance to retreat, and if that is not heeded immediately, I'll assume the worst and bust a cap.

To me, bottom line, some of society has become too permissive and tolerant of law breakers. Set a clear standard. Enter a property outside the residence and its trepass. Enter the residence, and it's assumed your intent is no longer porperty.

To be clear, you can shoot a guy in the knee cap and not kill him. Mission accomplished. If the guy can walk on one knee, than that one goes too.
