A hate crime? Absolute 100% in my eyes and more so a racially charged hate crime. But since white guilt and bowing down to blacks seems so "in" it will prolly be nothing more than his fault for speaking out against kids who happened to be black.
I noticed how they had to mention his past criminal record as if that has something to do with him getting beat by 20 people. Folks don't want to admit it or want to imagine that racism doesn't exist but it is rampant in the USA but they better wake up. It's sad that most people in the media are afraid to even say racism by blacks or just report a story for what it is.
IMO there should be no such thing as a hate crime. A crime is a crime, regardless of why it is done. Hate crime laws rank right up there with not having to prove who you are to vote as ignroant things that should be changed.
I'm not a fan of the definition now used to describe this junk, however it is just that if you want to use the label. Certainly a racially motivated crime without a doubt.

I have never been in favor of any concept called a "hate crime" that makes the punishment more severe based upon the nationality (or whatever) of the people involved. The crime is the crime and everyone should be punished consistently.
As a multi-racial (American Indian, white, Middle Eastern, African) married to a Brasilian of Syrian/Italian/black ancestry, I am very opinionated about this. Nobody gets screwed worse in our society than the white male, in the interest of political correctness. Black Americans are often every it as racist as their white counterparts, though in my eyes it's worse because society refuses to admit that it's racism.
It's the same kind of crap my friend Tóño deals with as a Mexican living in the mountains of western Virginia. People around here (black, white, and American Indians) all hate him because they see this guy with brown skin, greasy hair, and a couple cars that look like they were on *Pimp My Ride* and they assume he's an illegal immigrant and a drug dealer, when the reality is that he's a chef who has lived here legally for almost 20 years and has only 3 speeding tickets and a violation for fishing without a license 19 years ago.

Not all the time but if there is any public awareness to the crime and the Al and Jesse show pop in look out! It becomes a racial issue.
