Interesting take, but it seems to ignore one important fact: Romney disagrees with the ruling that the penalty is a tax. As one of his senior advisers, Eric Fehmstrom said, "The governor believes that what we put in place in Massachusetts was a penalty and he disagrees with the court's ruling that the mandate was a tax." Which makes it difficult for him to make much political hay out of this particular tax increase. IMHO, the similarities between ObamaCare and what Romney instituted in Massachusetts are going to be a big chink in his armor on this issue.
