This guy DID the right thing by stopping a crime and what did the cops do....they ARRESTED him.

I can't believe this happened in New Hampshire of all places. I guess "Live Free or Die" is just the state slogan, but not really a way of life.

So the homeowner was charged with reckless conduct not discharging a firearm. The local Co. Atty. is reviewing self defense and defense of property laws prior to indictement (makes sense).
This article reports it like he has been convicted and sent off to sing sing.
Shows how gun laws and self defense laws can vary from state to state and county to county. I think here in KY you have to believe your are at risk of personal injury before you can shoot in self defense I don't think you can shoot someone for crawling out of a window even if you ask him to stop and he runs.
Heck New Hampshire my well be more libral on property protection than we are if they allow you to shoot to protect property.

I would agree that they are more "libertarian" than most but this sure goes against their live free or die motto.
AND YEA.........it is my RIGHT to carry a firearm, and it is my RIGHT to protect myself.....Had he killed the SOB, that would be a different story.....Had he not had a gun and the SOB escaped, that too would be a different story.

So I have a bird bath in my front lawn. I circle it with a trip wire attached to a 12 ga. shotgun so that if anyone approches the bird bath to possibly steal it the shotgun blows their head off. Think thats OK.

His house was broken into. He WENT looking and found the SOB coming out of his neighbors' house. He figured the dude was MUCH bigger than he, so he discharged his firearm into the ground to ensure the SCUMBAG understood he was armed and would blow his LOSER ASS away.
I have NO problem summarily executing most LOSER criminals out there. They are SCUM of the earth.

I dont think the homeowner shot his weapon recklessly as he shot it into the ground. If he shot it in the air the bullet has to come down somewhere so that is reckless and it he shot it near the criminal that may be seen as reckless. But the bullet is in the ground not hurting anyone. I would think the police would have discreciation on whether to charge the 61 yr old victim on this. He was also a victim of the burgular. I would love to hear what the policeman who posts on this board says about the police charging this man. He is a law abiding citizen with no record. Doesnt seem right to me at all that he be charged. I hope his friends and family get some picket signs out and demostrate in front of the courthouse when this gets to trial.
I think maybe KY law allows you to protect your own property but it may not allow you to go to property other than your own and do so... This may be seen as taking the law in your own hands as another poster suggested... "castle Domain" might not extend to your neighbors property.

My initial point is that this story does not rise to National attention. We do not have enough information to know what happened. He said he said, was the bullit fired into the ground within an inch of his head. Let them do their jobs. I don't think he is convicted yet. The Co. Atty said he was going to look at the laws for self and property defense. They are going to investigate. Yes I would like to hear the cops side of this story, bet he could shed some light on this case. Somehow I don't think he is some leftist communist.

Yep New Hampshire is known for gun owning independent folks. This story surprises me and at the same time alarms me. The fact that this is even an issue bothers me......nationwide it seems the trend is insuring criminals are treated with kid gloves and not imposed upon while victims are scrutinized for being jerked out of their everyday life and reacting to being an victim. Just sayin....
