    Is there a 30 day buyers remorse for boats

    A buddy of mine just bought a boat. It leaks and they are delaying on the repair. It looks like they are trying to make things correct.

    Is there a 30 day buyers remorse law in Ky as there is for autos?

    There are various laws that may apply to buying a defective product but all of them depend on a lot of variables. Was it new, was it used, was it from a merchant, was it from an individual, was there a warranty, or was it purchased AS IS, are just some of the variables.

    It is a MYTH that there is a "30 buyers remorse law" for automobiles in Kentucky. No such las exists!!

    There is a law that applies to products that were purchase AWAY FROM THE SELLERS REGULAR PLACE OF BUSINESS, in other words, if a salesman comes to your home and talks you into buying something you may be able to "cool off:" and get out of the deal; however, if you go to a business or a boat dealer's showroom and buy a boat, there is no cooling off period.

    There may be a "maunfacture's warranty" for repair or replacement of a NEW PRODUCT but almost all used things are sold AS IS.

    The best thing to do is, what it sounds like he is already doing, TALK TO THE SELLER and try to work something out.

    He bought this from a dealer. The dealer is working with him as is the company whom manufactured it.

    I am not a lawyer but are you positive there isn't a buyers remorse law? I know of a guy whom bought a vehicle and returned it 4 days later and they refunded his money without question. Itis hard to believe any car dealer would do that!!!LOL

    There is no remorse law on autos or homes. There is a right of recision on timeshares here but not autos.

    I dont know about the laws which in my opinion dont mean much anyway since they can be twisted so much with fine print. However I will tell ya this without mentioning the manufacturers name. My brother bought a brand new boat and had it for 3 months and water was coming in the transum form cracks. The boat was taken to the manufacturer and was left there for 3 weeks before they called and told him it was fixed. He brought the boat by my house and wanted to go to the water to see if it still leaked and it didnt. After a few hours of run time it started again. This time he took the boat to a boat repair place and had them look at it. They said it couldnt be fixed because it was obviously put together wrong in the transum area. My brother took the boat back to the manufacter and showed them the estimate that stated could not be repaired. My brother asked for a new boat they laughed. I called my attorney and gave him the rundown on the whole thing. He called the manufacter and talked for awhile and they told my brother they would build him a new boat. He had to give my lawyer $50.00 but he got a new boat. So if the problem continues then hire a lawyer.

    if you want the boat then sounds like they are trying to do the right thing for you, unfortunately you bought a boat that ya wanted to use right away and couldn't, which Stinks.
    If you have no confidence in the way it needs to be repaired will last and want to get out of the deal, then you should find a lawyer with marine experience and have him give them a call, he will know all the right things to say to put the fear in them. Maybe they'll refund your money and transfer the boat back out of your name.

    Call some of the big yaht dealers, surely they know some good attorneys.

    Motolot, from your post it is not clear whether he bought the boat NEW or USED; whether it had a manufacture's warranty or if it was bought AS IS.

    Before paying for lawyer, your friend may also try to check with his local Better Business Bureau and see if there is anything they can help with.

    i had some problems with a 96 truck i bought new,the transmission was messed up along wih a few other things,it was drawn out over a few months.I checked wih a lawyer and was told about the lemon law and was also told that as long as the manufacturer works with you to try and repair the problem you have to give them the opportunity,now if the same problems persist you have the lemon law in your favor,if he is going to take any affirmative actions keep track of each and every conversation and have everything they say they'll do in writing and signed.keep all dates and times and names of who he speaks with.

    Ctfshwisher, your advice to: "keep track of each and every conversation and have everything they say they'll do in writing and signed.keep all dates and times and names of who he speaks with." is very good and something everyone should do when they have a problem with any defective product.

    However, the Kentucky Lemon Law applies ONLY to NEW MOTOR VEHICLES and does not apply to boats or boat motors, houses, appliances, or other products. As I said before, the buyer may have some recourse under a MANUFACTURE'S WARRANTY, in which case, he is doing the best thing he can to WORK WITH THE DEALER/SELLER. but the idea of a "30 buyers remorse law" is a MYTH, it does not exist in KY. Furthermore, a cooling off period does not apply in this case.

    I haven't read all the replies, but a couple of things. Last I knew for sure, any contract signed in KY, has a 72 hour period that it can be revoked.

    BTW, I had a Bronco I bought new for over 6 weeks, and the dealer could not fix a problem. With the proper "negotiation" and no other help, I got a full refund, including the payments I had made.

    Maybe that is what happened with your friend?

    yeah grumpy i just had a motor put in my 97 ford and it was a fishy situation from the get go,and because i didn't have record of who i spoke to or what was said when i had to fight with the people installing it,i got it back 3 weeks ago,they got the week before thanksgiving.from what i hear the lemon law is hard to get done.hope he gets the boat fixed right.
