Why does what he chose to rob matter? Did you look at the picture I linked above which shows him assaulting the clerk at the store? He didn't just shoplift he used force to rob the man, which is a violent felony!
I agree it is a shame he is dead, but the responsibility appears to lie squarely on him for a what appears to be a series of bad decisions which all lead directly to his death.
Just because you might not believe something shouldn't be illegal doesn't give you the right to assault someone and rob it. I really think you are missing the larger point if what you take from this is that the tobacco law should be changed. How about personal responsibility where people don't rob, assault, and then resist arrest?
