Obama should be able to appoint the next US Supreme Court Justice and change the make up of the court. Anyone want to bet that the GOP Senators and their leader Mitch will do anything in their power to stop Obama from appointing anyone to the court before his term is up? This is going to be a huge fight and with the election coming up the Dem could use this inaction as obstructionism and bang the GOP over the head with this.
It's the Presidents Duty and right to make the appointments to the US Supreme Court. But then it's the Senates duty and right to confirm any of those appointments. Obama's term will be up in Jan 2017 and the next President will be Elected in Nov this year 2016.
This is monumental as the current court is normally tied 4 to 4 in most controversial decisions. The appellate court makes the final decisions on the law if the US Supreme Court ties 4 to 4. The court will have to vote 5 to 3 to get any thing done with cases that they hear.
Appoint a moderate and one that doesn't legislate from the bench and the Senate will let it go through.Obama should be able to appoint the next US Supreme Court Justice and change the make up of the court. BUT I tell you this..........try a Kagan or Sotomayor.........GOOD LUCK.
This president , who has pushed so many actions by EXECUTIVE order , and I might add is having a significant amount of his legislation overturned by the SUPREME court, should not be able to appoint another person to the Supreme Court.
Obama has had his 8 years.
Like it or not, the Senate approves appointments, and I hope to GOD this senate blocks every single choice this president puts forth.....
If Clinton or Sanders is elected, I suspect a more "liberal" appointment will be made.
If a Pub gets elected, then a more "conservative" appointment will be made.
I find it unfortunate that the Supreme Court has even become such a political issue. It is even more important since the current president has been creating legislation, and quite a bit of that legislation is ending up in the Supreme Court.

Not true. Republicans took the senate last year......Obama had the House, the Senate and the Executive branch and could not get the **** done he wanted done.
What is AMAZING to me is that Democrats didn't deal with immigration when they had all 3 branches.
Talk about FOOLS.

A republican does NOT win the election?Mitch has left the GOP wide open with his record of voting for a new justice, but mitch lies about a lot of things, and doesn't remember other things. What if bloomberg jumps in? Moveon is right, nobahma should submit someone, and he may be clever enough to show how obstructionist congress has become. Lets wait till rumours of the super pacs begin to filter out, they run the country.
Even though the Democrats has a majority in the US Senate they didn't have a 3/4 majority to over ride any filibusters that blocked Obama an the Dems from making any new laws. The exception was the Affordable Health Care Act. You know this George yet you act like they had total control of the Senate and you know that they didn't. Lying by omissions? are we now?
Everyone knows that the Republican's were out to Get Obama and block anything and everything that he tired to do to help the people. Obstructionist would be a perfect name for the GOP.
Obama is still the President for another 10 full months and it's his duty to appoint a new supreme court justice Immediately. And it's the Duty of the US Senate to confirm the appointments in a timely manner with an up or down vote. To simply say that they won't even consider anyone that Obama nominates is simply playing Political Hard Ball in the biggest way. I hope this move costs the GOP the White House, Senate and the House in the upcoming election. Maybe the die hard republicans don't care if McConnell tries to destroy the Court and the Constitution but the independents will see this as being GREEDY and hopefully McConnell and the GOP will pay a huge price in this upcoming election.
There is a reason why GOD chose to take Antonin now before the election instead of waiting to take him after the election.
Any fool that follows American Politics could predict that the GOP controlled US Senate would fight Obama tooth and nail over anything he does.
God helps us if we let someone like Donald Trump put the next US Supreme Court Justice on the court.

There is an informal senate rule in place called the Thurmond Rule regarding a lame duck President making SCJ appointments. In the past it has been used by both political parties when it is to their advantage to do so. I would expect it to be the same this time and even disappointed if it is not. What goes around comes around or at least it does where I'm from.

Must be a great place, where is it? A few things have changed since"strom" was around. How far do you have to drive for internet service? But "medusa" mcconnel was there, and there was a lame duck POTUS who got his appointment nominated, that guy was A. Scalia.
They were an embarrassment to republicans everywhere..........
They need to get their heads out of their ass and come up with solutions.
Republicans could learn a thing or two from the Democrats on this front. You have fights on the Democrat side, but I don't seem to remember the battles between democrats being this bad. I could be wrong, but I doubt it.
